Introduction

Welcome to Battle 4 the throne. Battle 4 the throne is a talent hunt reality program which has been in existence since 2015 it was formally known as “Sabi Dance competition” and was re-branded in the year 2017 to include other talent sectors such as Music and comedy. By signing up for battle for the throne you agree, without limitation or qualification, to be bound by these terms and conditions and such other additional or alternative terms, conditions, rules and policies which are displayed or to which you may be directed in connection with any particular battle 4 the throne curriculum, all as may be modified by the organizers of Battle 4 the throne (Atrik worldwide) from time to time in its sole discretion (collectively the "Terms and Conditions"). If you do not agree with these Terms and Conditions, you may not take part in the battle 4 the throne.

Please note that we reserve the right, at our discretion, to change, modify, add, or remove portions of these Terms and Conditions at any time. Please check periodically for changes. Follow our pages on social media for the posting of any changes to these Terms and Conditions will mean you accept those changes.

For information on how user information is collected, used and disclosed by Atrik worldwide in connection with your Battle 4 the throne entry, please consult our Privacy Policy.

Restrictions on use of materials

All material, information and content (collectively "Content") used during Battle 4 the throne including the manner in which such Content is presented, and the Services are: Copyright 2024 Atrik worldwide, its affiliates and/or licensors. All rights reserved. Such Content is protected by worldwide copyright laws and treaty provisions. Atrik worldwide grants you a limited non-exclusive, non-transferable license to use and display on your computer or other electronic access device, the Content and Services for your own personal and non-commercial use only, provided that you do not modify the Content and that you maintain all copyright and other proprietary notices. Except as provided herein, you agree not to reproduce, make derivative works of transmit, distribute, sell, publish, communicate, broadcast or otherwise make available any of the Content obtained through Battle 4 the throne, including without limitation, by caching, framing or similar means, without the prior written consent of the respective copyright owner of such Content.

Trademarks

Battle 4 the throne and all associated designs and logos are trademarks of Battle 4 the throne. All other product, brand and company names and logos used or mentioned on Battle 4 the throne may be the trademarks or registered trademarks of their respective owners. Any use of any trademarks appearing on Battle 4 the throne program without the express written consent of the owner of the trademark is strictly prohibited.

Entry conduct

In consideration of Entries during Battle 4 the throne, you agree to comply with all applicable laws and these Terms and Conditions when you enter the Battle 4 the throne. You acknowledge that Atrik Worldwide may investigate any violations of law and may cooperate with law enforcement authorities in prosecuting defaulters in this regard. Additionally, you agree not to: post, transmit, link of, or otherwise distribute any materials, information or content from any other event on our platforms or encouraging conduct that would constitute a criminal offense or give rise to civil liability, or otherwise

Responsibility for minors

In cases where we have authorized a minor to enter into the Battle 4 the throne, such minor would need a guardian who recognizes that they are fully responsible for: (i) the conduct of such minor; (ii) controlling the minor's throughout the competition and (iii) the consequences of any misconduct by the minor. You acknowledge that you have full responsibility.

Forums and content submissions

By uploading materials to any of our platforms or otherwise submitting any materials to us through any other content generating or submitting content for Battle 4 the throne , you automatically grant (or warrant that the owner of such materials expressly grants)

YOU EXPRESSLY UNDERSTAND AND AGREE THAT: (A) BATTLE 4 THE THRONE PROVID YOU THE PLATFORM TO SHOWCASE YOUR TALENT AND MAKES NO ASSURANCE TO EXTABLISH YOU AS WELL AS TAKE CARE OF YOUR BILLS HEREBY EXPRESSLY DISCLAIMED, AND (B) BATTLE 4 THE RUNS ITS COMPETITION THE WAY IT WANT AND STANDS TO GIVE NO EXPLANATION ON WHY AND HOW THE GAME/COMPETITION TAKES PLACE  BATTLE 4 THE THRONE SPECIFICALLY MAKES NO ARRANGEMENT WITH NO CONTESTANT TO HOW OR WHAT SHAPE THE COMPETITION SHOW TAKES C) BATTLE 4 THE THRONE OWE NO CONTESTANT AND EXPLANATION WHY HE OR SHE WAS NOT SELECTED, AS WELL AS PRICE GIVING OR COMPENSATION FOR PARTICIPATING AND GETTING CUT OFF  D) ALL PROMOTION EFFORTS ONLY GOES TO THE WINNER OF BATTLE 4 THE THRONE  E) VOTING RESULTS FOR ARE NOT BEEN PROVIDED BY ATRIK WORLDWIDE AS THAT WE DO NOT HAVE ANY INFLUENCE IN THE VOTES OF CONTESTANTS.

Professional information disclaimer

The Battle 4 the throne may make available certain information provided by third parties related to various fields of the contest such as, Voting Numbers , medicine and other health and fitness related matters,. The contestant Professional Information is provided for entertainment purposes only and should not be interpreted as a recommendation for a specific treatment plan, or special course of action. You agree that all risk associated with the use of, or reliance on, any of the Professional Information rests with you. You further agree that Atrik worldwide, including its board, shall not be responsible or liable, directly or indirectly, in any way for any loss or damage of any kind incurred as a result of, or in connection with your Professional Information.

Financial information disclaimer

Any and all pictures, sounds, sound effects, sound recordings, musical works, performances, graphics, video, cinematic productions, audio-visual works and any other works (the "Multimedia Content") sent through Battle 4 the throne are protected by copyright and/or other intellectual property laws. Atrik worldwide does not have the right to authorize you to reproduce, distribute, publicly display, publicly perform, communicate or create derivative works from any files containing Criminal Multimedia Content.

Participate Conduct

CONTESTANTS OF BATTLE 4 THE THRONE IS TO ACKNOWLEDGE THAT ENTERING INTO THE COMPETITION COMES WITH SOME RESPONSIBILITIES. A) DAMAGING OF COMPANY NAME OR BATTLE 4 THE THRONE BRAND BY CONTESTANTS AFTER ENTERING INTO THE COMPETITION MAY GET YOU SUED FOR BRAND DAMAGE. B) PARTICIPATING IN THE BATTLE 4 THE THRONE MEANS KEEPING UP A GOOD BEHAVIOR PUBLICLY, IN A SITUATION WHERE PARTICIPATE IS INVOLVED IN ANY PUBLICITY SCANDAL, VIOLENT ACT, COURT CASE OR ANY FORM OF ACTIVITY WHICH MAY BRING A BAD IMAGE TO ATRIK WORLDWIDE OR TO THE BATTLE 4 THE THRONE. C) SUCH CONTESTANT OR WINNER WILL BE DROPPED FROM THE BATTLE 4 THE THRONE. YOU ACKNOWLEDGE THAT GOING AGAINST THE STANDARD OF THE BATTLE 4 THE THRONE MAY GET YOU SUED.

 

Monitoring

You acknowledge that Atrik worldwide has all obligations to monitor all activates carried on Battle 4 the throne platforms and content relating to the Battle 4 the throne. However, you agree that Atrik worldwide has the right to monitor Battle 4 the throne electronically from time to time and to disclose any information as necessary to satisfy any law, regulation or other governmental request, to operate Battle 4 the throne properly, or to protect itself or its users in accordance with the Privacy Policy.

Modifications

Atrik Worldwide reserves the right, in its sole discretion, to add to, remove, modify or otherwise change any part of these Terms and Conditions, in whole or in part, at any time. Except as otherwise expressly contemplated herein, changes will be effective when notice of such change is posted on Battle 4 the throne Platforms. Please check these Terms and Conditions regularly for updates by checking the date of "Last Update" at the top of this document. If any change is not acceptable to you, you must discontinue your participation in the Battle 4 the throne immediately. Your continued participation in the Battle 4 the throne after any such changes are posted will constitute acceptance of those changes. Further, Atrik worldwide reserves the right to change, modify, suspend or discontinue any aspect of Battle 4 the throne Content from time to time without notice or liability and for any reason whatsoever.

Dealings with third parties

You acknowledge and agree that your correspondence or business dealings with any third parties, including any promoters or advertisers, found on, or through, Battle 4 the throne or any of the platforms, including payment for and delivery of related goods and services, and all other terms, conditions, representations and warranties related to such dealings, are solely as between you and such third parties. Atrik worldwide assumes no responsibility whatsoever for any charges you or any user of your account incurs when making purchases or other transactions in this manner. Further, the responsibility for ensuring compliance with all applicable laws in connection with any such transactions shall be yours alone. You agree that Atrik worldwide shall not be responsible or liable in any way for any loss or damage of any kind incurred as a result of, or in connection with, any such dealings or transactions.

Indemnification

You agree to defend, indemnify and hold harmless each of Battle 4 the throne, its affiliates and licensors and each of their respective officers, directors, employees and agents, including all third parties mentioned on Battle 4 the throne platforms, from and against any and all claims, actions or demands, including without limitation reasonable legal and accounting fees, resulting from or related to: (a) your breach of any of these Terms and Conditions; (b) you’re your participation in Battle 4 the throne, platforms or Content; or (c) your use or reliance on, or publication, communication or distribution of anything on or from Battle 4 the throne. You shall use your best efforts to cooperate with us in the defense of any claim. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you.

Limitation of liability

YOU EXPRESSLY UNDERSTAND AND AGREE THAT IN NO EVENT SHALL ATRIK WORLDWIDE OR BATTLE 4 THE THRONE , INCLUDING ITS AFFILIATES AND LICENSORS, BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES, AND ANY DAMAGES FOR LOSS OF CONTENT, GOODWILL OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER ATRIK WORLDWIDE HAD BEEN ADVISED OF OR COULD HAVE FORESEEN THE POSSIBILITY OF SUCH DAMAGES, ARISING OUT OF OR IN CONNECTION WITH: (A) THE TASK, INABILITY TO PERFORM TASK GIVEN DURING THE BATTLE 4 THE THRONE, OR (B) ANY UNAUTHORIZED ACCESS TO OR MODIFICATION TO ANY OF YOUR CONTENT OR TRANSMISSIONS, OR (C) ANY OTHER MATTER RELATING TO BATTLE 4 THE THRONE ITS ORGANIZERS.

You expressly acknowledge that Atrik worldwide has entered into this agreement, and has and will make Battle 4 the throne Content and rules available to you in reliance upon the limitations and exclusions of liability and the disclaimers set forth herein, and that the same form an essential basis of the bargain between you and Atrik worldwide. You expressly agree that the limitations and exclusions of liability and the disclaimers set forth herein will survive, and continue to apply in the case of, a fundamental breach or breaches, the failure of essential purpose of contract, the failure of any exclusive remedy or termination of this agreement.

Governing law/jurisdictional issues

All Battle 4 the throne Accounts and contents  are controlled, operated and administered by Atrik worldwide from its offices within Africa. Atrik worldwide makes no representation or warranty that Battle 4 the throne is appropriate or available for participation at any locations outside Africa. If you access Battle 4 the throne platforms from outside Africa, you are responsible for compliance with all applicable laws. You may not export any of the Content accessible through Battle 4 the throne platforms in violation of applicable export laws and regulations. These Terms and Conditions shall be interpreted, construed and governed by the laws in force in Ghana, Nigeria, and South Africa without reference to its conflict of laws principles. Subject to the Arbitration and Actions paragraph below, each party hereby agrees to submit to the jurisdiction of the courts of Ghana, Nigeria, South Africa and to waive any objections based upon venue.

Arbitration and actions

Any controversy, claim or dispute arising out of or relating to these Terms and Conditions, your use of any Battle 4 the throne platform or the relationship which results from these Terms and Conditions, including without limitation, the performance, breach, enforcement, existence or validity of the matters provided for in these Terms and Conditions which cannot be amicably resolved, even if only one of the parties declares that there is a difference (collectively, a "Claim"), will be referred to and finally settled (to the exclusion of the courts) by private and confidential binding arbitration before a single arbitrator held in Ghana in English and governed by Ghana law. The arbitrator shall be a person who is legally trained and who has experience in the information technology field in Africa and is independent of either party. Any such Claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim, controversy or dispute of any other party. You agree to waive any right you may have to commence or participate in any class action against us related to any Claim and, where applicable, you also agree to opt out of any class proceedings against us. Notwithstanding the foregoing, we reserve the right to pursue the protection of intellectual property rights and confidential information through injunctive or other equitable relief through the courts.

 

 

 

FORCE MAJEURE

Any failure or delay in the performance by the Organizers of its obligations hereunder shall not be a breach of this Agreement and shall not constitute a failure, if such failure arises from acts of God; explosions, or fire; floods; hurricanes; tornadoes; lightening; earthquakes, drought; extraordinarily adverse weather conditions, epidemics; lockouts and other labor disputes not attributable to an act of a Party; war; revolution; invasion; insurrection; riots; sabotage or any other causes; provided however that with respect to those events which may be attributable to human acts, the foregoing definition shall apply only if it is determined that such claim of Force Majeure was or is beyond the reasonable control of either party.

SETTLEMENT

I.  The contestant or winners during the battle 4 the throne is to have a minimum average of ii.) 80% of the cash prize awarded and this will be calculated in votes value before full cash prize is given to the contestant or winners iii.) this will be done within 1-2 months after the program.

II. In a situation where the above condition is not met the winner’s prize is been divided into 3 quarters i. the first quarter will be used for the promotion of the winners ii. The second quarter will be used for winners’ management team during the cause of his or her reign iii. The third quarter will be given to the winner in cash after the official winner agreement contract is signed.  

III. The prizes money is to be paid to the Contestant or Winner before the contract commence

IV. If at any time the winner of the Event is been offered a business, promotional or  Ambassadorial deal during his/ she’s time as a winner of the Battle 4 the throne the Event organizers will gets 20% of said deal which will still be used to push the contestant.

 

NDA (NON DISCLOSURE AGREEMENT)

I. The Contestant, must under no condition or situation State the content of this agreement to any 3rd party (anyone outside both parties group) if a contestant is under an external contract with a 3rd party in form of Management or promotional label said information must be made know to the Organization before joining the competition.

Ii. All Agreements made between both parties are to be kept confidential and must not be shared or disclosed with any 3rd party outside the parties group.

Iii. All material given to The Contestant is to be kept confidential until been asked to be published or shared with the public.

Iv. If any vital information which could jeopardize the Event in anyway or cause ham to The Organizer is been released or leaked from The Contestant, The Contestant will be held accountable and sued for image Slander and will be fined a huge payment to cover up the damage been done.

 

 

Termination

You acknowledge and agree that Battle 4 the throne, in its sole and absolute discretion, may, without notice to you, suspend or terminate your Entry or your participation in the program, and remove and discard any information or content related to Battle 4 the throne or Atrik worldwide (and your participation thereof), for any reason, including where Atrik worldwide believes that you have violated any of these Terms and Conditions. You further agree that Atrik worldwide or Battle 4 the throne shall not be liable to you or to any other person as a result of any such suspension or termination. If you are dissatisfied with Battle 4 the throne procedure or arrangements or with any terms, conditions, rules, policies, guidelines, or practices of Atrik worldwide in operating Battle 4 the throne, your sole and exclusive remedy is to discontinue from the battle 4 the throne.

Submission of ideas and/or suggestions

Atrik worldwide is always improving its Event and developing new ways to make the events better and more entertaining. If you have ideas and/or suggestions regarding improvements or additions, we would like to hear them - but any submission will be subject to these Terms and Conditions. UNDER NO CIRCUMSTANCES SHALL ANY DISCLOSURE OF ANY IDEA AND/OR SUGGESTION OR RELATED MATERIAL TO BATTLE 4 THE THRONE OR ATRIK WORLDWIDE BE SUBJECT TO ANY OBLIGATION OF CONFIDENTIALITY OR EXPECTATION OF COMPENSATION. BY SUBMITTING THE IDEA AND/OR SUGGESTION OR ANY RELATED MATERIAL TO ATRIK WORLDWIDE, YOU ARE WAIVING ANY AND ALL RIGHTS THAT YOU MAY HAVE IN THE IDEA AND/OR SUGGESTION OR ANY RELATED MATERIAL AND ARE REPRESENTING AND WARRANTING TO ATRIK WORLDWIDE THAT THE IDEA AND/OR SUGGESTION OR ANY RELATED MATERIAL ARE WHOLLY ORIGINAL WITH YOU, THAT NO ONE ELSE HAS ANY RIGHTS IN THE IDEA AND/OR SUGGESTION OR ANY RELATED MATERIAL AND THAT ATRIK WORLDWIDE IS FREE TO IMPLEMENT THE IDEA AND/OR SUGGESTION AND TO USE THE RELATED MATERIAL IF IT SO DESIRES, AS PROVIDED OR AS MODIFIED BY ATRIK WORLDWIDE, WITHOUT OBTAINING PERMISSION OR LICENSE FROM ANY THIRD PARTY.

General provisions

This agreement is personal to you, and you may not assign your rights or obligations to anyone. These Terms and Conditions constitute the entire agreement between Atrik worldwide and you pertaining to your participation in the Battle 4 the throne and  supersede any prior agreements between you and Atrik worldwide with respect to the subject matter hereof. Atrik worldwide’s failure to insist upon or enforce strict performance of any right or provision of these Terms and Conditions shall not constitute or be construed as a waiver of any right or provision. If any of the provisions (or parts thereof) contained in these Terms and Conditions are determined to be void, invalid or otherwise unenforceable by a court of competent jurisdiction, such determination shall not affect the remaining provisions (or parts thereof) contained herein. No changes to these Terms and Conditions shall be made except by a revised posting on this page or except as otherwise expressly contemplated herein. The parties have required that these Terms and Conditions and all documents relating thereto be drawn up in English.
